Cancellation & Refund Policies

GENERAL RESERVATION CANCELLATION AND REFUND POLICY

If you are (i) an individual or legal entity; or (ii) a travel or tour agency operating as an individual or legal entity ("Agency") ("You") and have made (on your own behalf or on behalf of third parties) one or more reservations for any service offered through the website: https://amigotours.com/ ("Website"), operated, managed, and/or owned by Operadora Arozarena, S.A. de C.V. and/or Amigo Group Europa, S.L. and/or Amigo Tours New York, LLC and/or Amigo Tours LTD (each individually for the purposes of this document, "AMIGO TOURS" and depending on the destination of the service contracted through the Website). You expressly agree to be bound by this General Reservation Cancellation and Refund Policy (the "Policy") once the reservation for any service contracted through the Website has been confirmed by AMIGO TOURS through the issuance of a confirmed reservation (a "Confirmed Reservation"). Therefore, we ask that you read this Policy carefully before conducting any transaction through the Website.

I. CANCELLATIONS AND MODIFICATIONS

You may request AMIGO TOURS to make modifications, cancellations, or additional specifications to your Confirmed Reservation, recognizing that any resolution to your request for cancellation, modification, or additional specifications will strictly depend on the availability of the service you have contracted through the Website. Therefore, AMIGO TOURS establishes, as a general rule, a period of at least 24 (twenty-four) hours prior to the start time of the service for you to be entitled to a refund of up to 100% (one hundred percent) of your Confirmed Reservation. It is understood that the Website and/or your Confirmed Reservation may specify a longer time or period for certain services, in which case said time or period will, for all purposes, be the minimum period for making any cancellation, modification, or additional specifications to said service or the Confirmed Reservation.


AMIGO TOURS manages tickets to museums, archaeological sites, monuments, parks and, in general, to any location owned and/or managed by third parties included in a Confirmed Reservation on a group basis. Therefore, you understand that AMIGO TOURS does not deliver individual tickets or issue refunds in the event of modifications or cancellations.

II. NO-SHOW.

If you, your companion(s), or any of them/their clients, third-party beneficiaries of the services, or any of them simply fail to show up for the tour or service contracted (no-show) under a Confirmed Reservation, you expressly agree that no refund will be applicable for any reason and under any circumstances. Tickets and access to parks, monuments, and museums are managed by AMIGO TOURS on a group basis, so AMIGO TOURS cannot make personal or individual delivery of tickets under a Confirmed Reservation.


In the event of a no-show for tours or services contracted under a Confirmed Reservation in Cancún, Quintana Roo, and Mexico City, managed and operated exclusively by AMIGO TOURS, they may be rescheduled for other dates, subject to a penalty. You will be informed of this penalty on the day you request the modification, at AMIGO TOURS's sole discretion.

III. FORCE MAJEURE:

This Policy does not apply in the event of unforeseen circumstances or force majeure, such as hurricanes, closed ports, excessive traffic, floods, muddy or blocked roads, tropical storms, epidemics, pandemics, or any other natural or man-made phenomenon beyond the control of AMIGO TOURS. In these cases, only the policy for changing the date of your Confirmed Reservation will apply, and on a case-by-case basis and at AMIGO TOURS' sole discretion, a full or partial refund of the Confirmed Reservation may be issued.

IV. CANCELLATIONS OR MODIFICATIONS OF CONFIRMED RESERVATIONS MADE THROUGH THIRD-PARTY PLATFORMS FOR SERVICES OPERATED BY AMIGO TOURS:

This Policy does not and will not apply to reservations or service orders made by Agencies or third parties through websites other than the Website or other platforms managed, operated, or owned by third parties, for services operated by AMIGO TOURS. Please refer to the cancellation policy, terms of service, or their equivalent of said Agency or third party to manage any cancellation or modification to the contracted service.

V. REFUND PAYMENT METHOD.

Except in extraordinary cases, all refunds will be made directly to the bank card linked or associated with the Confirmed Reservation. Please note that the time it will take for you to see a refund or cancellation of the charge does not depend on AMIGO TOURS. We suggest you contact your card-issuing bank for more information.

VI. SITE TERMS AND CONDITIONS / DATA PRIVACY.

For information related to the terms and conditions of the Site and how we handle your data, please refer to the terms and conditions and privacy policy contained on the Site.

VII. MODIFICATIONS AND UPDATES TO THIS POLICY.

AMIGO TOURS may modify, expand, remove, correct, or update this Policy at any time and at its sole discretion. In all cases, we will publish the date of last update of this Policy on the Website, and that date will be considered the effective date of the Policy for all legal purposes and applicable to any Confirmed Reservation or service contracted through the Website.


We may also communicate these changes through the Website via pop-up messages or windows, or by sending you an email if we have your address, but we are not obligated to do so.
